1. Who we are
BeWealth Advisory (“BeWealth,” “we,” “us,” or “our”) is the practice of Marcus Brutoco, an Investment Advisor Representative offering financial planning, retirement income planning, and investment advisory services. Securities and investment advisory services are offered through Fortuna Investors. Annuity and insurance products are offered through Annuity Gator.
This Privacy Policy describes how we collect, use, store, share, and protect personal information when you visit bewealth-advisory.com, contact us, become a prospective client, or engage our advisory services.
2. Information we collect
We collect personal information that you voluntarily provide to us when you:
- Submit a contact or intake form on bewealth-advisory.com
- Schedule a meeting through Cal.com or another scheduling tool we use
- Engage with us by email, phone, or text message
- Become a client and complete a financial-plan intake or onboarding process
The categories of information we may collect include:
- Identity information: name, age, date of birth (when relevant for retirement planning), state of residence
- Contact information: email address, phone number, mailing address
- Financial information: assets, income, retirement-plan details, investment accounts, tax filing status — collected only when you choose to share this in connection with a financial planning engagement
- Communications: emails, text messages, scheduling correspondence, and meeting notes generated during our engagement
We also passively collect basic technical information when you visit bewealth-advisory.com (browser type, IP address, pages visited). This information is collected via standard web logs and is not used for marketing.
3. How we use your information
We use your information to:
- Respond to your inquiries and provide the advisory services you request
- Schedule meetings and send appointment confirmations, reminders, and follow-up materials
- Prepare financial plans, illustrations, and recommendations based on the information you provide
- Comply with regulatory recordkeeping requirements applicable to investment advisor representatives and registered investment advisors (FINRA / SEC retention rules, currently 3-6 years)
- Communicate with you about your account, applications, e-signature requests, and account servicing
- Improve the quality of our services and the content of bewealth-advisory.com
We do not use your information for advertising or to send marketing campaigns to lists. We do not sell your information.
4. SMS messaging and consent
If you provide your mobile phone number and consent to receive SMS messages, we may send you appointment confirmations, reminders, document-ready notifications, scheduling coordination, and conversational follow-up tied to your engagement with our practice.
Consent to receive SMS messages is collected explicitly — either through the SMS consent checkbox on our intake or contact form, or through direct verbal or written confirmation during a call or meeting (which we log to our records). Consent to receive SMS messages is never a condition of any purchase or service, and you may engage with our practice without consenting to SMS.
Message frequency varies based on your engagement, typically 0 to 5 messages per month. Message and data rates may apply.
You can opt out of SMS messages at any time by replying STOP to any message you receive from us. We honor STOP, STOPALL, UNSUBSCRIBE, OPT OUT, OPTOUT, REMOVE, QUIT, CANCEL, and END (case insensitive). You can request help by replying HELP.
We do not share your phone number or SMS opt-in status with any third party for marketing purposes.
For complete SMS Terms & Conditions, including supported carriers and customer care contact, see our SMS Terms & Conditions.
5. How we share your information
We do not sell, rent, or share your personal information for marketing purposes.
We may share information in the following limited circumstances:
- With Fortuna Investors, the registered investment adviser (RIA) where Marcus Brutoco’s IAR license is held, as required for regulatory recordkeeping and supervision of advisory communications
- With Annuity Gator, when an annuity product is part of your engagement and the carrier requires application or suitability documentation
- With service providers we engage to operate our practice (e.g., scheduling software, financial planning software, customer relationship management software, e-signature platforms) — only the information necessary for the service, and only under terms that require those providers to protect your information
- With regulatory authorities when required by law, subpoena, or examination by FINRA, the SEC, or applicable state regulators
- With your explicit consent in any other circumstance not listed above
We do not share your information with social-media platforms, advertising networks, or marketing-data aggregators.
6. How we store and protect your information
We take reasonable measures to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. These measures include encryption of stored client information, access controls on our systems, and regular review of our data-handling practices.
Records subject to FINRA / SEC retention requirements are retained for the periods required by those regulations (currently 3-6 years for advisor communications, longer for certain client records). Other personal information is retained only as long as necessary for the purpose for which it was collected, after which it is deleted or anonymized.
No method of transmission or storage is 100% secure. While we use reasonable efforts to protect your information, we cannot guarantee absolute security.
7. Your rights
You have the right to:
- Request access to the personal information we hold about you
- Request correction of any information that is inaccurate or out of date
- Withdraw consent for SMS messaging at any time (see Section 4)
- Withdraw consent for email communications at any time by replying to any email with an unsubscribe request
